Leila Linhares Barsted was interviewed on May 7th by TV Educativa (TVE) presenting considerations about the new Equal Pay Law that guarantees the payment of equal salaries for men and women who exercise the same function. The law will apply to all employees who work under the Consolidation of Labor Law (CLT) contract model.

Since 1943 the CLT has provided for equal pay for men and women working in the same position. However, this is not the reality for women. Now, the bill will be sent to the Senate, where it will be given a new number. If it is approved, it will be sent to the President’s sanction. The new law establishes the obligation of equality, which will be verified through documentation, expanding the forms of inspection and fines. To this end, companies with 100 or more employees must publish salary and remuneration transparency reports every six months. The reports must contain the amounts received by the employees. If the report is not submitted, the company will be fined up to 3% of the payroll. This information will be made public by the government through the internet. Besides the salary differences, there will be an administrative fine for the employer in case of discrimination because of sex, race, ethnicity, origin or age, which will be equivalent to ten times the value of the new salary due to the discriminated employee and will be doubled in case of repeated discrimination.
