“In a case of attempted femicide in Minas Gerais, the intimate conviction of jurors, based on misogyny, was accepted as a valid legal argument to maintain the acquittal of the accused by the popular jury. And what is worse: the First Panel of the STF ( Supreme Court), by three votes to two, granted a habeas corpus to reject the appeal of the Public Prosecutor’s Office, which demanded the realization of a new trial, accepting the defendant’s defense because he considers that the jury’s decision is sovereign and that the jurors can decide for acquittal based on their intimate convictions.
Therefore, we express our perplexity at the decision of the First Panel of the Supreme Court, which, on September 29th, kept the acquittal of a man who tried to stab his ex-wife out of jealousy. Alexandre de Moraes and Luís Roberto Barroso voted in favor of a new trial. Both questioned, each in its own way, the legitimacy of the argument based on the wounded honor in the 21st century. The case will again be voted on by the STF. ”
